  1. This Promotional Competition (“Competition”) is organised by PVM Energy Bar (Proprietary) Limited and its agencies (“Promoter”).
  2. The Competition is open to permanent residents and citizens of South Africa over the age of 18 (eighteen) years, in possession of a valid South African Identity Document or any minor over the age of 13 (thirteen) with a guardian in possession of a valid South African Identity Document, except any minor, any employee, director, member, partner, agent or consultant or any person directly or indirectly who controls or is controlled by the Promoter and/or immediate family members of any employee, director, member, partner, agent or consultant of or person indirectly or directly in control or controlled by the Promoter, its advertising agencies, advisers, dealers, suppliers identified by the trademarks owned by or licensed to The PVM Group of Companies, its affiliates and/or associated companies.
  3. By entering the Competition, all participants and the winners agree to be bound by these rules as interpreted by the Promoter, whose decision regarding any dispute will be final and binding. The Promoter reserves the right at any time, without notice, to amend, modify, or change these rules, and to postpone, suspend or cancel this Competition and any prizes (which have not yet been subject to a draw), or any aspect thereof, without notice at any time, for any reason which the Promoter reasonably deems necessary.
  4. The Competition is only valid within South Africa. Participants must be within South Africa at the time of entering the Competition, for the verification process and at the time of the prizes being awarded should they be declared a winner, failing which such person will be disqualified and the draw of a replacement entry shall take place under the same terms and conditions as the first draw.
  5. The Competitions commence on 3 February 2020 until 30 August 2020 (“the Duration”). The winners will be announced monthly via the Brand Social Media Platforms.
  6. The social media video competition participants stand a chance to win amonthly prize to the value of R 5000.

Data scratch card participants stand a chance to win a minimum in R 30 000 worth of airtime over the competition duration.

  1. Participants will be required to do the following on the TIkTok, Facebook or Instagram social media platforms (“Brand Social Media Platforms”) for a chance to win :
    1. Submit their PVM Energy Bar video through the #ChallengeAccepted and #PVMEnergyBar hashtags on the Brand Social Media Platforms;
    2. Download any Brand Social Media Platform, create profiles and Like the Promoter’s Brand Social Media Platform pages;
    3. Show how you #boostmental performance and #boostphysical performance. Make a video, take a picture, just be creative! You can also post a unique mental or physical ability, show anything energetic, entertaining or do something good!
    4. Upload videos on public social media platforms
    5. You can use a soundtrack. Remember to use the hashtag #ChallengeAccepted #PVMEnergyBar and tag your friends to see if they will accept a similar challenge in return;
  1. All social media video entries will be reviewed by a panel of judges who will short-list the valid entries. The judging panel will then pick a monthly winner/s for the Duration of the competition. The Promoter’s decision is final and no correspondence will be entered into. Entrants amount of likes & shares on the post will increase chance of winning and will be one of the criteria to select the winner/s. The panel of judges can split the cash prize if deemed necessary.
  2. All winners will be notified via a direct message (“DM”) on the Brand Social Media Platforms with a subsequent follow up to confirm their details on the dates listed in clause 5 above.
  3. Once the possible winners are notified via direct message on the Brand Social Media Platforms, winners will have 24 (twenty four) hours from the day they are contacted to respond to the winner notification. If any possible winner fails to respond within 24 (twenty four) hours, the Promoter reserves the right to draw another winner.
  4. In order for the particular entries to be confirmed as valid, the possible winners will be required to provide their contact details and e-mail address, in order for the Promoter to contact the possible winner with the follow up verification process and the next steps required in order to deliver their Prize. The Promoter will contact the possible winners via email and conduct a Competition verification process.
  5. Participants, whose entries have been selected and have been confirmed as valid after the verification process, will be emailed, by the promoter, an order form for the winner to complete as set out in cause 15 below, and send the order form back to the Promoter within 24 (twenty four) hours so that their Prize can be delivered to the correct e-mail delivery address.
  6. If the Promoter is unable to reach a Winner after 1 (one) week from the date of being declared a Winner, or if Winner is a minor who did not obtain their parent or legal guardian’s consent, or if Winner fails the verification process after drawing his/her Entry for whatsoever reason, such person will be disqualified and a draw for a replacement Entry and winner will take place.
  7. The Winners will need to provide their full name, contact number and email address. The Promoter will advise the winners when they will receive their Prize, which will be delivered to an agreed upon address.
  8. To claim their Prize, winners will be required to complete the order form stated in clause 12 above, provided by the Promoter.
  9. Please note that Prizes are non-exchangeable and once delivery has been made to winners, the Promoter will not take responsibility for any product malfunction or defect. Ownership of and risk in and benefit attaching to, the Prize will pass on to the winner immediately.
  10. Participants may enter the Competition subject to the following:
    1. No automated entries will be allowed and all entries must be made by a natural person manually on the Brand Social Media Platforms.
    2. If any entry was made in a manner which in the Promoter’s discretion provides the participant with an unfair advantage over other entrants, such a Participant will be disqualified from this and all future competitions run by the Promoter.
    3. Participants may enter this Competition as many times as they like provided they complete the entry mechanics set out above, each time. However, Participants are only eligible for 1 (one) Prize under this Competition. Participants who have won a prize in a competition run by the Promoter in the past 6 (six) months, are not eligible to win a Prize.
  11. The Prize winners are obligated to behave responsibly and comply with the Competition rules and all reasonable requests of the Promoter and its agents.
  12. The Prizes are neither transferable nor redeemable for cash. The Promoter reserves the right to substitute the Prizes with any other prize of comparable commercial value.
  13. Should any dispute arise in relation to the interpretation of the Competition rules, the Promoter’s decision shall be final and no correspondence shall be entered into regarding the decision.
  14. All participants and the winners, as the case may be, indemnify the Promoter, it’s advertising agencies, advisers, nominated agents, partners, suppliers identified by the trademarks owned by or licensed to The PVM Group of Companies, its affiliates and/or associated companies against any and all claims of any nature whatsoever arising out of and/or from their participation in any way howsoever in this Competition (including, as a result of any act or omission, whether as a result of negligence, misrepresentation, misconduct or otherwise on the part of the Promoter and/or use of the Prizes).
  15. The Promoter may require the winners to be identified, photographed and published in printed media, or to appear on radio and television, when accepting their Prizes or after having received their Prizes. The winners will be given the opportunity to decline to the publication of their images and to participate in the Promoter’s marketing material in so far as it relates to the Competition. The Promoter may use the uploaded images in whole or in part, and any reproductions thereof, worldwide for advertising, promotion, publicity or otherwise on any website for any media purpose and for any other lawful purpose whatsoever.
  16. By entering the Competition, the participants agree that the PVM Group of Companies and its affiliates (including the Promoter, subsidiaries and joint ventures) may contact the participants via email and through social media platforms to deliver marketing communications regarding their products and promotional activities. The Promoter may also use the personal data collected from the participants and that such use may include transfers to the Promoter’s affiliates and third party service providers in any country.
  17. The Promoter may require the winners to complete and submit an information disclosure agreement and indemnification to enable the Promoter to ensure compliance with these Rules and the Consumer Protection Act 68 of 2008. Should any winner refuse or be unable to comply with this rule for any reason, such a winner will be deemed to have rejected the Prize and it shall revert back to the Promoter.
  18. The Competition is in no way sponsored, endorsed or administrated by, or associated with Facebook, Instagram or TikTok. Participants voluntarily provide their information to the Promoters and not to Facebook, Instagram or TikTok however the Participants are required to take note of the following:
    1. As this Competition requires Participants to comment/post anything in relation to the relevant Brand Social Media Platforms, Participants’ comments/posts must be original and written by them. For the purposes of these Rules, “comment/post” includes but is not limited to, any written material or visual or audio material such as an image, a photograph, a sound or visual clip. Participants may not use someone else’s post or work as their post. Participants may not comment/post material that is derogatory or harmful to the Promoter or the social platforms.
    2. Participants may not misuse the social media platforms, or the PVM Energy Bar brand or Competition in any way. This includes posting content for commercial purposes or distributing spam or malicious code or using the site to collect the personal data or content of other users or direct visitors to other sites or pages.
    3. Posts must not contain any content that is normally prohibited on the relevant social platforms such as explicit or offensive content.
    4. The Promoter has the absolute discretion to decide if Participants actions constitute any of the actions prohibited in terms of these Rules and to end their participation in the competition immediately and take appropriate legal action. The Promoter may also immediately remove any posts that they reasonably believe constitute any prohibited content without notice to the Participant.
    5. Participants must comply with the terms & conditions and privacy policies of the social media platforms.
    6. The Promoter is not responsible for the social media platforms. The Promoter cannot control how they operate, when or if they are available, or what content they carry. Even though the Promoter runs the Competition on the site, the Promoter does not endorse the third party, its site, its products, or services or any content on the site. Participants use the site at their own risk. Participants must take all necessary measures to protect themselves and any minors, from risks, such as viruses and other destructive code.
    7. Participants must obtain at their own expense all equipment and services that are necessary to gain access to the social media platforms to take part in this Competition.
    8. The Promoter can put in place such technical or other remedies it considers appropriate to prevent abuse, or to protect any sites or our systems or other users.
    9. If any Participant does not comply with these Rules, their posts can be deleted and they will not be allowed to access the site or take part in the Competition.
    10. By posting any content, experiences, images on any social media platform, in relation to this Competition and its associated promotional activities, Participants consent and give the Promoter a world-wide, royalty free and non-exclusive license, to reproduce, modify, adapt and publish any content posted and/or submitted by a Participant on a social media platform, for the purposes of promoting the products and services of the Promotor.
  19. A copy of the Competition rules is available at no cost to the participants and can be downloaded in printable form at https://energybar.co.za/.
